The Supreme Court of India has agreed to begin the final hearing of petitions challenging the Promotion and Regulation of Online Gaming Act, which took effect on May 1, 2026, and imposed a nationwide ban on online real-money games.
The constitutional challenge, led by Dr. K A Paul, questions whether the Act’s prohibition on online real-money games is constitutional. Petitioners are of the view that applying a nationwide ban to both games of chance and skill-based games such as poker could conflict with protections allowing individuals to conduct lawful business activities.
The court is also set to consider a public interest litigation filed by the Centre for Accountability and Systemic Change (CASC) over the country’s restrictions on online gambling and real-money gaming.
CASC is seeking directions requiring the central government to act against online gambling platforms that it alleges are presenting their services as social gaming and esports.
Represented by former Uttar Pradesh DGP Vikram Singh and Shourya Tiwari, CASC has asked the court to require action against betting and gambling applications that it claims are causing social and economic harm across India. CASC’s legal representative told the court that authorities have not responded to the organization’s petition despite earlier court orders issued in October last year.
Lawyer Virag Gupta, the petitioner, also said details of approximately 2,000 gambling apps had previously been submitted, with the platforms allegedly offering betting and gambling services in India in violation of the law.
