A New York poker player who resides in a $4 million condo is facing an $87,000 lawsuit from neighbors who are fed up with his marijuana habit.
Chau Shing Lam, who has over $300,000 in live tournament cashes recorded by The Hendon Mob, resides in a ritzy condominum in Manhattan at 368 Third Avenue, and some neighbors have complained about the secondhand smoke.
A complaint was filed against Lam on July 17 by the Board of Managers of 368 Third Avenue Condominum — the plaintiff. The complaint accuses the poker player of smoking marijuana and tobacco in his unit “on a near-daily basis and at all hours of the day and night, causing noxious smoke to infiltrate neighboring units and common areas.” He also allegedly “creates excessive noise disturbances” emanating from his unit.
What’s in the Complaint?
Neighbors claim they hear “loud banging, running around, and yelling” coming from Lam’s unit late at night, court documents show. But there’s a bigger issue in play that has led to managers of the condominium filing a lawsuit.
The community has alleged that Lam’s smoking habit has created poor air quality in the building and has one future resident concerned due to a child’s medical condition.
Air quality monitoring conducted in the adjacent unit, per the complaint, shows “dramatic and repeated spikes in PM2.5 (fine particulate matter) levels consistent with secondhand smoke infiltration.”
The complaint claims the air quality levels caused by Lam have become “unhealthy for all persons” and “extremely dangerous for a child with reactive airway dysfunction syndrome.”
An exhibit submitted to the court by a pediatrician who treats a 12-year-old child with such a condition who will be moving into an adjacent unit to Lam states: “I recommend that all reasonable measures be taken as promptly as possible to eliminate the child’s exposure to secondhand smoke within the home environment.”
Lam has received more than a dozen violations from the condo board due to neighbor complaints over a two-year period. He has racked up over $87,000 in penalties and lost access to certain amenities. As such, management of the property has asked the court to force the poker player to pay those fines and quit it with the excessive smoking.
Lam, who has competed in World Series of Poker and WSOP Europe events in the past, spent some time this summer in Jeju where he cashed in seven events at the Red Dragon Poker Tour’s summer series. He also cashed four times at the PokerStars European Poker Tour (EPT) Monte Carlo series in May.
