The Rio de Janeiro City Hall has prohibited outdoor and public-space advertising for fixed-odds betting platforms and online gambling applications across the municipality.

The restriction, established under Rio Decree No. 58,274 of July 10, 2026, covers advertising structures, street furniture and other spaces whose operation requires a municipal license, authorization, permit or concession. The decree was published Monday and took effect immediately.

Advertisers and advertising companies are required to remove existing advertisements and adapt authorized advertising devices to comply with the new rules. The application of fines is suspended for a maximum, non-extendable period of 10 days from the decree’s publication.

The Licensing and Inspection Coordination Office, or CLF, is responsible for enforcement and may order the immediate removal of noncompliant advertisements.

Offenders, including advertising display companies and advertisers, are also subject to penalties under Article 124 of Law No. 691 of December 24, 1984, as amended by Complementary Law No. 269 of December 12, 2023. Advertising licenses or authorizations may be immediately revoked or annulled, without excluding other measures available under applicable legislation.

The measure applies to trademarks, business names, digital platforms, websites, applications, commercial promotions, institutional or promotional campaigns, and bonuses, prizes or incentives connected to betting. It also covers logos, symbols, visual elements, mascots, slogans and other features that directly or indirectly identify companies authorized to operate fixed-odds betting or platforms used for such activities.

Municipal agencies and entities must apply the restriction when executing, renewing, extending or reviewing contracts, concessions, permits, authorizations, licenses and other arrangements involving advertising on municipal property or in spaces subject to municipal regulatory authority.

The prohibition also extends to advertising campaigns and events contracted, sponsored or conducted by the direct or indirect municipal administration.

The decree adds Article 37-A to Rio Decree No. 55,648 of January 13, 2025, prohibiting outdoor or exterior advertising for virtual fixed-odds betting at events, including trademarks, logos, symbols, designations, expressions, slogans, icons, pictograms, images and other graphic elements.

City Hall cited the municipality’s authority to regulate urban land use, territorial planning, the urban landscape, municipal public assets and advertising spaces subject to local approval.

It also referred to Articles 30, I and VIII, and 182 of Brazil’s Constitution, as well as Articles 83, VIII, and 84, II, of Complementary Law No. 269 of 2023, which prohibit advertising considered offensive to morals and good customs or harmful to the rights of third parties and individuals.

The decree states that overexposure to fixed-odds betting and electronic gambling advertising has negative effects on mental health, particularly among children and adolescents. It also cites Article 16, III, of Federal Law No. 14,790 of December 29, 2023, as a basis for restricting gambling advertising.
