Rivers Casino Philadelphia will face a proposed class action lawsuit over a 2024 data breach after a federal judge denied the operator’s motion to dismiss the case.
Judge Joshua D. Wolson of the U.S. District Court for the Eastern District of Pennsylvania ruled on August 7 that plaintiffs had adequately pleaded a negligence claim against Sugarhouse HSP Gaming LP and Rush Street Gaming LLC, which own and operate Rivers Casino Philadelphia.
The plaintiffs claim the companies failed to maintain adequate safeguards for sensitive information, allegedly violating obligations under common law, contractual requirements, industry practices, and the Federal Trade Commission Act.
The lawsuit stems from a breach discovered around Nov. 18, 2024, when an unauthorised actor accessed and allegedly exfiltrated files from the casino’s computer servers.
Rivers Casino Philadelphia began notifying affected individuals around Dec. 30, 2024, about six weeks after discovering the breach. The casino also filed a notice with the Massachusetts Attorney General’s office.
The compromised information reportedly included names, Social Security numbers, and bank account details used for direct deposits. Both current and former employees and customers were affected, although the casino has not disclosed the exact number of people impacted.
The case is one of at least three lawsuits filed in the Eastern District of Pennsylvania following disclosure of the breach. An earlier suit filed by a Radnor-based law firm on behalf of a Philadelphia resident sought class-action status, compensatory damages and other relief. Levi & Korsinsky and Edelson Lechtzin have also separately investigated the breach on behalf of potentially affected individuals.
Plaintiffs argue that the delay in notifying victims reduced the time available for them to take steps against potential identity theft and fraud.
With the motion to dismiss denied, the case will proceed to discovery, potentially providing more information about the scope of the breach and Rivers Casino Philadelphia’s data-security practices.
